1. Who we are
Lumina Presence ("we", "us") builds websites and connected business tools for small businesses. This policy explains how we collect, use, disclose and protect personal information under Canada's Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial laws. Our Privacy Officer can be reached at hi@luminapresence.com.
2. What we collect
- Contact details you give us through our forms, by phone, text or email: name, business name, industry, phone, email and your message.
- Client account information: billing contact, invoices, payment status and project details in your client portal.
- Payment information: card payments are processed by Square. We do not store full card numbers.
- Marketing preferences: whether you agreed to receive marketing emails and/or texts, when, and the wording you agreed to.
- Technical information: basic usage data such as pages visited, device type and approximate location, used to keep the site working and improve it.
For clients who use our add-on tools, those tools also process information about your customers (for example, a caller's phone number for missed-call text-back). In that case, you control that information and we process it on your behalf, only to provide the service.
3. Why we use it
- To reply to your enquiry and book your demo.
- To build, host and support your website and tools.
- To invoice you and process payments.
- To send marketing emails or texts, only if you gave express consent.
- To meet legal, tax and accounting obligations and to protect our services from fraud and abuse.
4. Consent and marketing (CASL)
We collect, use and disclose personal information with your consent, except where the law allows otherwise. Our marketing consent boxes are always unticked and separate for email and SMS; you don't need to tick them to get a reply.
You can withdraw consent at any time: use the unsubscribe link in any email, reply STOP to any text, or contact us. Withdrawing marketing consent doesn't affect messages we must send to run your account, such as invoices.
6. Where it is stored
Some of our service providers store or process information outside Canada, including in the United States. When that happens, the information is subject to the laws of that country and may be accessed by its courts or authorities. We choose providers that use strong safeguards.
7. How long we keep it
We keep personal information only as long as we need it for the purposes above or as the law requires (for example, financial records for tax purposes). Enquiries that don't become clients are deleted or anonymised when they are no longer needed.
8. How we protect it
We use encryption in transit (HTTPS), access controls, secure third-party payment processing, and we keep API keys and passwords out of our website code. No system is perfectly secure, but we take reasonable steps to protect your information and will notify you and the Privacy Commissioner of Canada of any breach that creates a real risk of significant harm.
9. Your rights
You can ask to see the personal information we hold about you, ask us to correct it, or ask us to delete it where the law allows. Email hi@luminapresence.com and we'll respond within 30 days. If you're not satisfied, you can contact the Office of the Privacy Commissioner of Canada.
11. Changes and contact
We may update this policy and will change the date at the top when we do. Questions or complaints: hi@luminapresence.com or (604) 210-8575.
